Let's delve into the constitution and see if the current president really had violated it in any way. First we have to preface that the constitution was not made by the government for the people. Instead, it was written by the people for the government so that the latter remains fair to all denizens and dwellers. As such, for any constitution changes and even amends you have to consult with everyone in OT.
Without further ado, we are beginning the pre-trial investigation submitted by Jangsoodlor, the serving chairman of the UWU party, and led by Kobold84, the serving government clerk. The current agenda is to determine possible constitutional contraventions and if there were any impeachable offenses done within the president term. This is NOT a trial. The investigation is done only to establish whether it's rightful to start a trial that will decide the president's fate.
This is pretty bad. Not for Patatitta, but for the previous president. No parliament was elected if you don't remember. If this goes through, any denizen chosen during the eblf term might get their status revoked. However, this will probably overcomplicate things. So as long as the current parliament doesn't mind that denizens were elected without legitimacy, they can mutually agree to give such legitimacy to the past decisions. All in all, crisis averted.OT Constitution wrote:
The denizens shall practice their legislative powers through the OTParliament, wherein the representatives being voted for are voted through free elections for which each individual's vote shall be classified as secret.
It is NOT an impeachable offense.
First real issue. The parliament elections were not hold among denizens, the right to vote was given to anyone. This does pose a problem for the parliament elections. However, the current president was chosen by denizens, as such it is NOT an impeachable offense.OT Constitution wrote:
IV.a. The right to vote in the elections is reserved for denizens of OT whom have gotten denizenship.
If you really wanted to, you could hold new parliament elections, but honestly, it goes against the spirit of the law. After all, dwellers are as important as denizens.
You could argue this is indeed a breach. There are currently 3 elected parliament members along with the president. So 4. One elected individual is not present and that would be Hydreigon. As he was not given a seat in the parliament, all decisions coming from the government are missing that one person. You got it right, it IS an impeachable offense.OT Constitution wrote:
VIII. There shall be no less than elected 5 representatives into the OTParliament, wherein one of them serves as the president.
So this is why the report was initially submitted. Indeed, it is written in plain text, the president shall swear the oath. Considering Patatitta did not do that, there's an argument he became a president to "unrightfully execute the Office of President of OT, and will not to the best of his ability, preserve, protect and defend the constitution". In layman's terms, he became the president in bad faith. Also, you could argue no speech addressing the state of OT was made, but that is more up to your interpretation.OT Constitution wrote:
XXXVI. Before entering office, the president shall swear the following oath: "I solemnly swear that I will rightfully execute the Office of President of OT, and will to the best of my ability, preserve, protect and defend the OTConstitution."
XXXVII. The president shall at the start and end of his term, give a speech addressing the State of OT, and recommend to the OTParliament what to do.
It IS an impeachable offense.
To conclude this investigation, some might ask "can you even indict THE president?" and yes, you can:
RESULT: THE INVESTIGATION HAD FOUND TWO IMPEACHABLE OFFENSES, THE TRIAL WILL BE HELD IN OT COURT AFTER THE DISCUSSION PHASE IN THIS THREAD IS OVER.
In this case going against the constitution could be considered a high crime. However, there could also be other issues done by the serving president, if you have any grudges or have something to report against Patatitta, please leave a message in the thread. It will be further discussed during the trial proceedings.OT Constitution wrote:
XXXVIII. The president, and all other civil officers of OT, shall be removed from office on conviction of high crimes and misdemeanors
