Also considering the constitution was never really enforced and was made at a time when OT was very different it makes no sense to start enforcing it now.
Example of that is the oath, if the constitution was made today it wouldn't be a thing and no one actually cares about it, some dude just dug it up with the intention of abusing it to go against the result of rightful elections.
All in all if there is a trial it will be in bad faith.
