Hi! :)

I'm working on a beatmap at the moment - It uses the introduction from an old anime from the early 90's. I'm writing the beatmap, but I do not own the rights to the music or video which is being used on this -particular- beatmap.

I've noticed that there are many, many dozens of beatmaps, regularly circulating osu!, which use copyrighted material - Lady Gaga, Naruto and etcetera as examples.

My question - What is the actual stance on copyrighted material here at osu!? Obviously, this would be purely for entertainment value, as there's neither the way nor the intention of making any money from osu, but if I was to attempt to publish this beatmap to osu!, is there any chance that I could get into trouble for it (being what I suspect to be, like many other beatmaps released thus far, based on copyrighted material)?

I do intend to, eventually, release a number of beatmaps based on my own musical compositions, but I'm just starting out at the moment and haven't yet released anything - Working on pre-established works ad interum, until I get the hang of the editor.

I.. Couldn't help but notice that the phone number of the "designated agent" resolves to my own local area, and I know a bus that drives past my house that also drives past that office address.. Interesting. o.0

Anyhow, thanks for the reply. I was looking for something along the lines of what you'd linked to, but didn't end up finding it prior to.

Based on what I read (via the supplied link), I don't think I'll be able to safely publish the beatmap in question. However, I do wonder - From my understanding of the DMCA, at least half of the beatmaps available in publicly available beatmap packs would fall into the same category, and yet, thousands of members play them on a daily basis and they remain readily available. :-/

I'm fairly certain the related content of the beatmap in question is copyrighted. However, I'm also fairly certain that the copyright holders wouldn't see it worth their time to complain about it if they found out about it - Given initial release date (1992), and that the anime in question (from which it came from) only aired in Japan, and no where else in the world, and only for a very short period of time (was a short half season release, based off a somewhat larger manga series, which has also since discontinued), the most up to-date copyright for the relevant content would be at least 19 years old.

Would you guys risk it? Or better to just keep it private? How about those beatmap packs which contain beatmaps made by members containing commercial copyrighted music - What do they do in order to make it okay (by make it okay, I mean, make sure that it doesn't contravene the osu copyright policy or copyright law).

There really shouldn't be any risk in mapping songs.
I do not of any case where someone's been sued for publishing songs in their maps.

Risk it. By your extensive precautionary attitude I assume this is probably the first time you've thought about doing it. Really no action can come against you.

It's as you said. They are not going to find out about it and if they do they probably won't do anything. They're looking at the mainstream things like pirating sites, youtube, file sharing sites. Not a relatively unknown game that seeks no direct profit.(Technically indirectly as people will pay for membership if they like the music. I suppose.)

Do it and worst case scenario you get a slap on the wrist. You're not a repeat offender by any means and you've done enough precautionary thinking.
