Are AI Upscaler tools allowed for any map?

so basically, if I found the original background having too small dimensions, may I use an AI Upscaler to upscale it to 1920x1080 for a background image in a map? (yes ik min dimensions are 160x120, but the original background is in 640x480)

though with the one you got i'd rather just find a better quality one instead
